Trade and services
Within the frames of the program of socio-economical activities of 2012 the Department of Trade and Service of the Municipality of Yerevan carried out the following activities:
To organize more efficient control over meeting the requirements of the RA law "On trade and services" the department together with public order maintenance service of the Municipality of Yerevan, workers of corresponding subdivisions of the staffs of the heads of the administrative districts arranged various inspections as a result of which large-scale measures directed at prohibition of open-air trade of agricultural products, ice-cream by weight, soft drinks without factory packaging and other products, funeral services, building materials in the streets and avenues of Yerevan as well as in yard areas. Due to carried out activities sales of the goods permitted for open-air trade by the RA law "On trade and services" are mainly carried on in the streets and avenues of Yerevan; permanent control has been set to exclude illegal open-air trade. Trade has been also regulated in underground crossings of Yerevan.
The open-air trade permitted by law has been also regulated. Flowers are mainly sold from open pavilions.
During the inspections a number of refrigerators provided for selling ice-cream and soft drinks and open flower pavilions placed without permission have been removed from streets. Due to private investments a small-scale market of agricultural products has been arranged in the administrative districts of Arabkir, Achapnyak, Nor Nork, Davtashen and Avan.
In Kasyan street, in the area lined with Khorenatsi street and Tigran Mets avenue and at Aharonyan 10/5 markets of agricultural products have been arranged where only the producers of these products trade.
On the event of declaration of Yerevan World Book Capital a fair-exhibition of books was organized in Mashtots avenue.
To fulfill the requirements determined by law regarding selling of goods related to funeral services (prohibition of open-air trade, covering shop-windows with curtains or darkening) tight control was set over the entities engaged in the mentioned activities, records were drawn up towards violators of the law.
Due to the control set over car parking sites functioning in Yerevan activity of 300 illegal parks has been prohibited. A number of cases of using larger areas than it was fixed by contracts were revealed. Due to carried out measures the violations were eliminated and new treaties were signed.
During the year the department carried out consistent activities to reveal violations fixed in paragraphs 158, 162, 169.16 and 180 of the RA Code on administrative violations, to draw up the records of the cases.
The total number of records drawn up towards administrative violations revealed in the spheres of trade, catering and personal services in the administrative districts in 2012 is 3396. 545 cases of them were drawn up by the 158th paragraph of the RA Code on administrative violations, 2134 cases-by 162nd paragraph, 707 ones-by paragraph 169.16 and 8 ones-by paragraph 180.
The amount of penalties applied because of fixed violations in the spheres of trade, catering and personal services in the administrative districts has made up AMD 90,6 million. In comparison with the previous year in 2012 the number of entities carried out control increased by 439, the number of drawn up records increased by 1128 or 1,6 times, the amount of penalties applied for administrative violations increased by AMD 55,2 million or 2,6 times.
As a result of control of the Department of Trade and Service the number of records drawn up for administrative violations was 1661 or 704 records more than the previous year. 317 cases of them were by paragraph 158 of the RA Code on administrative violations, 958 cases by paragraph 162, 379 ones by paragraph 169.16, 5 cases-by paragraph 180. The amount of the applied penalties made up AMD 55,3 million or 3,4 times more than the previous year.
In accordance with paragraph 180 of the RA Code on administrative violations in connection with applications-complaints or alarm phone-calls regarding violation of norms of music and noise level after 22.00 jointly with the employees of Hygienic and Anti-epidemic Department of the Ministry of Health inspections were carried out in Myasnikyan, Isahakyan, Leningradyan, Margaryan, Koghbatsi, Sayat Nova, Mashtots, Tigran Mets and other streets and avenues and certain actions were taken to eliminate the found out violations and defects.
The Department also studied the permissions given by the heads of the administrative districts for selling alcoholic beverage and tobacco, liquid fuel, compressed natural gas or liquid oil gas and technical liquids, selling and buying items made of precious metals, open air trade organization, to the entities engaged in trade, catering, lottery and gambling, to saunas, casinos for working after 24.00, the presence of local duties payment and in cases where the local duties were not paid actions were taken towards getting permissions and payment of corresponding local duties. To strengthen the control over the mentioned entities and to increase the efficiency of work data collected in electronic files are regularly checked.
Due to taken actions the number of permissions as well as the amount of local duties entered the community budget increased.
So, in 2012 in comparison with the previous year the growth of the amount entered community budget from the sphere of trade and services grew by 19.8 % or AMD 112.3 million more. Instead of 557.8 million anticipated for 2012 AMD 678.3 million been collected and the plan was fulfilled by 117.4% (AMD 100.5 million more was collected).
Essential actions were taken towards revealing the cases of selling expired products and drawing up corresponding records. Totally 233 records of cases of selling expired goods were drawn up in 2012.
The Department carried out activities to improve the legislation of trade and service field provided by the program of 2012. New suggestions were worked out regarding making changes and amendments the laws "On local self-government", "On local duties and fees", in the RA Code, in the RA Code on administrative violations. These suggestions were submitted to the RA Government and changes and amendments were made in the mentioned laws and in the Code on their basis.
The required control was set over neutralization of stray animals. In 2012 "Unigraph-X" Ltd neutralized, sterilized or put down 46089 animals. According to chapter 4 point 24 part 1 of the rules of pets registration and keeping in Yerevan, by the decision 2912-N dated March 30, 2012 of the Mayor of Yerevan the list of aggressive dogs was determined.
In the 2012 the Department received 245 applications-complaints from the residents, 1749 letters and notes were received from the municipality subdivisions and different organizations and the main part of them related to noise in trade, catering and entertainment entities bothering residents, to illegal pavilions and stalls and their dismantling, to giving permissions for open-air trade, placing stalls and pavilions, to residents' anxiety with stray animals, to organization of car park activity, illegal open-air trade, administrative violations and to other problems. Due to actions taken by the Department the illegalities discussed in the applications-complaints have been mainly eliminated.
The Department of Trade and Service gave interviews regarding the sphere to nearly all TV companies, public radio and other mass media.
Legislative proposals will be submitted with the aim of regulation of street trading and pedlary.
Systematic and effective control is to be set in the sphere of trade and service.
Necessary control is to be set over permissions given by the heads of the administrative districts of Yerevan for selling tobacco and strong drinks, liquid fuel, compressed natural or liquid gases and technical liquids, buying and selling items made of precious metals, organization of open-air trade, giving permissions to entities engaged in trade, public catering, lotteries and gambling, saunas, casinos for working after 24.00, as well as over local duty payment.
Open-air trade is to be taken under control and regulated.
To regulate trade of agricultural products in the capital the process of organization of fairs and markets of agricultural products, consumer goods in the administrative districts at weekends and holidays is to be continued.
To create small-scale markets of agricultural products at the expense of private investments their localization is to be determined, town-planning package is to be worked out.
Regular actions are to be taken in commercial entities to reveal cases of selling expired products and its prohibition.
The control over car park activity in Yerevan is to be directed at revelation of the facts of using larger areas then it is determined by contracts and at elimination of illegalities.
To regulate the problem of public lavatory it is planned to attract private investors. Town-planning package is to be worked out and the building developers are to be given alienation of program packages by auction or open procedure.
To open markets of animals in Yerevan studies are to be carried out and their location is to be determined.
Necessary control is to be set over the process of neutralization of stray animals.
Mechanisms of efficient management of the sphere are to be worked out and proposals are to be submitted with the goal of formation appropriate legislation ( to work out draft laws "On animals", "On animals' protection").
