Residents affected by illegal construction development wait for court decision

Liana and Adrianus who is Dutch by nation have been married for 11 years. Their flat is at 95,Andranik street and it used to be their beloved nook on the second floor overlooking a green area full of trees. However, the view from their balcony immediately changed when their new neighbour from the first floor decided to cut down the trees to build a stone construction instead of the green area.
Liana Akunts informed that they applied to the Municipality as soon as they saw trees cut down and the construction appear instead.
They cut down 40-year-old trees. And there was no permission. The husband, Adrianus van den Nieuvenhuizen expressed gratitude to the city authorities for rapid response and outlined that it is important that the illegal construction be tumbled down.

The employees of Yerevan Municipality service of public order protection made up a protocol on June 21 and the illegal construction at 95,Ansranik street was to be dismantled, but…

On June 28, Vardan Hovsepyan who occupied the area illegally, appealed to the court against Mayor’s decision. The administrative court in the person of judge Rafik Khandanyan, took the case into proceedings on June 30 and on the same day made the verdict to prohibit the Municipality to dismantle the illegal construction and to release the community-owned land plot. On July 20, the Municipality of Yerevan submitted a petition to the administrative court to cancel the measure to secure the claim. It is already the 4th day but the court doesn’t show the same hurriedness. There is another similar example when the court satisfied the citizen’s claim for construction of a stall just within a day, but the response to th municipality was given weeks later.
Adrianus urges people not to develop illegal constructions and find the legal way for their activity. He added that he really loves Armenia and respects its laws. He also expressed hope that the Mayor’s attitude to illegal constructions won’t change and the problem will find its solution.

Adrianus, who is an architect, says that such problem used to be rooted in the Netherlands and it became possible to solve it only by dismantling illegal constructions, applying fines, increasing penalties and even claiming compensations from developers.
So, the residents of the mentioned above block of flats are waiting for the court decision which will e followed by the activities of the City Hall.
